Va. Deputies Cleared in Fatal Shooting of NC Man Holding BB Gun

Prince George Co. found no evidence of criminal misconduct

A prosecutor says two deputies who fatally shot a North Carolina man after a chase in Virginia won't face any criminal charges.

Prince George County Commonwealth's Attorney Jay C. Paul says an investigation found no evidence of criminal misconduct by Hopewell sheriff's deputies Jerry E. Studer and Rodney A. Womack Sr.

The Richmond Times-Dispatch ( ) says Paul issued his opinion Thursday.

State police say Studer pulled over a vehicle driven by 21-year-old Robert L. Henderson III of Fort Bragg, N.C., on Interstate 295 on Dec. 18, 2011. Henderson then drove off.

The deputies boxed in Henderson's vehicle about 2 miles away. Henderson got out of his vehicle holding a BB gun that resembled a handgun. He was shot after he ignored orders to drop the weapon and fled on foot.
