Man Dies After ‘Underage Drinking Party' in Maryland

A 25-year-old man died Sunday after an "underage drinking party" in Montgomery County, Maryland, police said. 

Diego Padilla, of Gaithersburg, died after partygoers found him unresponsive in a swimming pool on the 5800 block of Winegrove Court in Derwood, Maryland, Montgomery County police said.

Officers and an EMS crew arrived about 2:40 a.m. Padilla was rushed to a hospital, where he was pronounced dead.

Ten adults age 18 to 20 and one juvenile were charged with possession of alcohol by persons under 21, and charges are pending against the hosts of the party. 

The hosts, two adult brothers, initially refused to let officers from the police department's Alcohol Initiatives Section enter to investigate, police said. Officers contacted the homeowners -- who had been out of town -- who allowed police to enter. 

Officers saw "several extremely intoxicated people" outside the house and "large quantities of alcoholic beverages" on the back deck, police said.

The investigation is ongoing. No foul play is suspected in Padilla's death, police said.

Maryland Gov. Larry Hogan signed a bill into law in May that will toughen punishments against adults who provide alcohol to minors in limited situations. Named after drunken driving crash victims, Alex and Calvin's Law prohibits adults from allowing young people to drink underage if the adult "knew or reasonably should have known" a young person would drive, and then someone is seriously hurt or killed in a car crash. A violation of the law is subject to a year in jail and a fine of as much as $5,000.

But Alex and Calvin's Law doesn't go into effect until October, and only applies to cases involving car crashes. 

"Unfortunately, this case would fall under the old law," Montgomery County Police Department spokesman Officer Rick Goodale told News4.

Alexander Murk and Calvin Jia-Xing Li, both 18, were killed when drunken driver Samuel Ellis, 19, lost control of his car in North Potomac. Ellis was sentenced last month to four years in prison.
