NCAA Seeks Dismissal of Wrongful Death Suit

The NCAA is going to court seeking dismissal of a wrongful death lawsuit stemming from the death of a Frostburg State University football player during practice in 2011.

The hearing is scheduled Tuesday through Friday in Montgomery County Circuit Court in Rockville.

The NCAA says it has no duty under Maryland law to prevent football injuries. It says Derek Sheely knew the risks when he chose to play football, and that it neither increased those risks nor caused his death.

Sheely's parents say he died from brain swelling caused by second-impact syndrome. They say that's when one suffers a head injury before an earlier one has healed.

They say the NCAA deliberately downplayed the risks associated with such injuries, and that their son did not fully understand them.
