Court: Lord & Taylor Can Stay Open Against Mall's Wishes

A court has ruled that a Lord & Taylor department store can remain open, despite the fact that the rest of the popular Montgomery County shopping mall has been leveled for redevelopment as part of a plan that is now in limbo.

Three judges of the Fourth Circuit Court of Appeals upheld a 2015 decision that the White Flint Mall's owners breached an easement agreement with Lord & Taylor when they promised to maintain the property as a "first class'' mall until at least 2042, WTOP-FM reports. 

The future of the mall in Kensington remains uncertain, since the decision, which was published on Tuesday, puts a further hold on the owners, Lerner Enterprises and The Tower Companies, from moving forward with an $800 million redevelopment plan.
