Judge Grants Jennifer Garner Permanent Restraining Order Against Alleged ‘Stalker'

Jennifer Garner was granted a permanent restraining order against a man the actress claimed provided a threat against herself and her family.

A judge granted the permanent order on Thursday. The order, which applies to Garner, as well as husband Ben Affleck and daughter Violet, will expire in November 2011.


Neither Affleck nor Garner was present at Thursday’s hearing. Attorney Blair Burke was present on the family’s behalf.

In her request for the permanent order, Garner claimed Steven R. Burky, 36, had been “stalking and harassing” her and allegedly turned up at her home multiple times, claiming God sent him visions related to her death.

In her declaration, Garner claimed that Burky first surfaced in 2002, and “engaged in obsessive and harassing behavior.” The actress claimed he sent her “multiple packages and letters containing delusional and paranoid thoughts,” and followed her “around the country, through multiple different states.”

The actress claimed she feared “not only for my personal safety, but also for the safety and well being of those that I love and care about most, including my husband and my daughter.”

Although Garner had asked the judge to order Burky to stay 200 feet away from the family, the judge issued the order to keep Burky at a distance of 100 feet.

Burky was not present at Thursday’s hearing and had no legal representation on his behalf.

On November 7, a judge had issued a temporary restraining order, requiring the 6’1” tall, 145-pound Burky to stay 100 feet away. In issuing the order, the judge deemed there was a “credible threat of violence.”
