A Miami man who police say was shot after asking a man to stop urinating on his lawn remains in critical condition as police continue to search for his shooter.
Jose Diaz Martinez's family says he was at his home just blocks from the Calle Ocho Festival Sunday when he and his father-in-law saw a man walk up and start to pee on the front fence of the residence at 1818 SW 3rd Street in Miami.
When the two men asked him to relieve himself elsewhere, the man got angry and shot Diaz Martinez five times -- once in the leg, once in the back and three times in the chest -- said Marelyn Merlos, the victim's sister-in-law.

"We heard the shots and we got outside and he was on the floor bleeding," she said.
The father of two is still in the hospital in critical condition.
The shooter then ran away in an unknown direction. Merlos believes he would have shot her father, too, if he had not run out of bullets.
