Prince William County Sues Federal Government Over Immigration Records

Prince William County, Virginia is suing the federal government over a freedom of information act request the county said was unfairly denied.

Police said Carlos Martinelly Montano was driving drunk last August when he crashed into a Toyota Corolla, killing a Benedictine nun.

Montano was an illegal immigrant who had been convicted of driving under the influence twice before and turned over to Immigration and Customs Enforcement. He had been released pending a deportation hearing.

Prince William Board Chairman Corey Stewart said the county has been trying to find out why Montano was allowed to return to the community, and is now asking a court to compel ICE to release more information.

"We are very concerned that the Montano case is just the tip of the iceberg. That he is not the only criminal, dangerous illegal alien who they have released back onto the streets rather than deporting them," he said.

ICE said it does not comment on pending litigation.
