Assistant principal's child porn charge thrown out

LEESBURG, Va. -- A Loudoun County judge dismissed a child pornography possession charge filed against a county school official because he decided the picture just wasn't all that pornographic after all.

Freedom High School assistant principal Ting-Yi Oei was arrested in August after law enforcement officials said he had an inappropriate cell phone photo of a female student taken by another student. He was charged with possession and two counts of contributing to the delinquency of a minor.

But on Tuesday, Judge Thomas Horne threw out all charges. In an opinion, Horne says the photo was not sexually explicit enough to constitute child pornography.

The defense argued in court papers that Oei obtained the photo as part of a school investigation into rumors that students were circulating nude photographs.
