Judge To Hear Request to Have Virginia Tech Verdict Set Aside

Virginia is asking a judge to set aside a jury's negligence finding stemming from the deadly April 2007 killings at Virginia Tech.

Virginia is asking a judge to set aside a jury's negligence finding stemming from the deadly April 2007 killings on the Virginia Tech campus.

A hearing is scheduled Wednesday in Franklin County Circuit Court on the state's motion. It will be heard by Judge William Alexander II, who presided over the trial in Christiansburg.

Jurors awarded $8 million to families of two students who were among the 33 left dead on the Blacksburg campus after a rampage by a lone gunman. Attorneys successfully argued the university waited too long before alerting the campus of the first two shootings.

The state has cited multiple issues in requesting the verdict be set aside, a first step toward an appeal. An attorney for the parents says the jury's ruling should stand.
