Man Detained in Aruba Denied Appeal

A court in Aruba has rejected a Maryland businessman's appeal of the order detaining him as a suspect in the presumed death of his travel companion.

The decision means Gary Giordano will have to stay in jail at least for the remainder of the 60-day detention period imposed on Aug. 31. The ruling came after a hearing before a three-judge panel on Wednesday.

Giordano has been ordered jailed while authorities investigate him as a suspect in the presumed death of 35-year-old Robyn Gardner. His lawyer said he was disappointed and does not believe there is enough evidence to hold him.

Giordano says the Frederick, Maryland woman was swept out to sea while snorkeling off the Dutch Caribbean island Aug. 2.  Giordano has been held by Aruban authorities since Aug. 5, when he was stopped trying to leave the country.

His father, Frank Giordano, told the Today Show this week that his son's conditions in jail were "miserable."
