Bush Ordered to Testify in SMU Land Lawsuit

Former President's legal team appeals judge's ruling.

A judge ruled that former President George W. Bush should be deposed in a lawsuit challenging the site of his proposed presidential library.

Bush's attorneys were working Friday on an appeal that would trigger an immediate stay of state District Judge Martin Hoffman's ruling.

The library is to be built on the Southern Methodist University campus. Two former condominium owners are suing, claiming SMU bullied them into selling their property without disclosing plans for it.

Attorneys for the property owners want to know whether SMU officials told Bush of their plans. The plaintiffs have obtained statements from top SMU officials and former White House counsel Harriet Miers, who answered questions under oath for hours.

The judge ruled former first lady Laura Bush would not have to testify.
