Judge Issues How-to Order in Virginia Attorney General Recount

A recount court's chief judge has outlined the rules governing the recount in the race for Virginia attorney general.

The order issued Wednesday by Richmond Circuit Judge Beverly Snukals stakes out many procedures that have been previously outlined at court hearings.

In the final order, the court allows attorneys for Democrat Mark Herring and Republican Mark Obenshain access to a full array of election materials.

Herring's attorneys had attempted to limit access to election materials that would not be relevant in a recount. But Obenshain's team argued those materials would be needed if either candidate pursued a contested election before the General Assembly.

Herring's attorneys successfully argued that partisan recount observers should not be allowed to “suggest” which ballots should be subject to challenge.

Herring has a 165-vote edge.
