The restaurant named best burger joint in D.C. by USA Today is being ordered to stop grilling by a D.C. Superior Court judge.

Rogue States opened near Dupont Circle in February and since then, owner Raynold Mendizabal said, business has been booming. But a neighboring law firm, Steptoe and Johnson, argues that fumes from burgers on the grill have become a nuisance to its employees.

And on Tuesday a judge agreed. He ordered the restaurant to stop grilling.

Mendizabal said he would consider changing location, "but that doesn't mean that the investment that we put in here is going to be recovered.  We lost everything. I don't even think we're going to have the money to open another one."

He said he hopes to negotiate with his landlord to install a new ventilation system to address the complaint.
