The family of a Prince George's County man shot and killed by a sheriff's deputy is planning to file a civil lawsuit demanding a criminal indictment.

According to police, Ricardo Minor and his ex-girlfriend were in a fight about two months ago, when she called 911 for a domestic disturbance involving a gun. Two Prince George's County Sheriff's Deputies arrived to the home and talked to the woman, who told them Minor assaulted her, then left to get a gun just before the deputies arrived.

When Minor returned to the home, police say he didn't listen to their verbal commands, made hand movements and one of the deputies shot and killed him.

"He does not own a gun and he is not violent," Ricardo's mother Michele Minor said.

The deputy has been identified as 4-year veteran Kendal Wade.

Ricardo's mother says she has hired attorney Mark Howes to help her file suit. The woman who called police that day did not want to speak with News4.
