Former Anne Arundel County Executive John R. Leopold said he should be allowed to run for public office while on probation.
Leopold's lawyer, Bruce Marcus, filed a brief this week with the Maryland Court of Special Appeals saying that condition of Leopold's sentence should be stricken.
Leopold resigned his post in February after being convicted of two misdemeanor counts of criminal misconduct. He served 30 days a jail, paid a fine and performed community service.
Leopold appealed his case when he was sentenced, and the Court of Special Appeals is scheduled to hear his appeal in January.
"The Capital of Annapolis" reports that in the 90-page brief, Marcus argued that the judge infringed on the powers of the county and the state in barring Leopold from running for office.
