FBI Agent Convicted of Assault in Maryland

A Montgomery County, Maryland, jury found an FBI agent guilty of assault following a five-day trial.

The jury saw video showing 45-year-old Agent Gerald Rogero III get involved in a couple’s custody dispute Dec. 5 in Chevy Chase because his girlfriend knew one of the parties.

A father delivered a baby late, starting an argument in which a 15-year-old boy got involved.

The video shows Rogero shoving the teen hard to the ground. The teen then grabbed the leg of the agent, who pulled out his service weapon.

The jury found Rogero not guilty of first-degree assault or use of a handgun during a crime of violence but convicted him of second-degree assault.

"You just can not misuse your authority as a police officer and not be held accountable," Montgomery County State's Attorney John McCarthy said.

The prosecution asked for Rogero to surrender his guns, but the judge decided he needs them to do his job until sentencing.

Rogero hopes to save his job by asking for probation before judgement.

"A probation before judgement does strike a guilty verdict, and he could therefore say he's never been convicted of a crime," explained Rene Sandler, a former prosecutor who is know a defense attorney.
