Assault Charges Dropped in Va. Beauty Queen Battery Case

Victim said he can't remember what happened

A judge dropped assault charges against former Virginia beauty quick Brittany Nicole “Nikki” Poteet Thursday.

Poteet walked out of the Richmond area courthouse saying she’s happy about the outcome.  She was Miss USA 2011 and Miss United States 2012.

Poteet was arrested March 18 after a domestic dispute with James McElroy, her ex-boyfriend. In the criminal complaint McElroy accused the 26-year-old of punching him and snaring him with a fish hook. Officers said there was dried blood around his mouth.

As prosecutors Thursday asked McElroy to tell the court what happened, he said he didn’t remember.  The judge subsequently dismissed the misdemeanor assault and battery charges.

In November 2011, Poteet made headlines after her roommate accused her of making gay slurs. She denied it.

Poteet also gave back her Miss United States crown after she posted a photo on Facebook that shows her in the crown with the caption:  Miss Alcoholic USA.
